Apple V Samsung War Shock Twist As iPad King Credibility In Doubt, Warns Judge

The legal battle between the iPhone and Galaxy has taken a startling new twist as Apple’s credibility is called into question as the judge refuses to believe Apple’s crocodile tears.Apple, who earlier this month applied to the US District courts to expedite the legal patents case against Samsung, has had its application refused by Judge Lucy Koh due to lack of grounds for the motion. 


Steve Jobs’ giant had sought to kick off the briefing period prior to the formal case earlier than planned on July 21st, but will have to hold out until more than a month later August 24, according to IB Times. 
 
Speeding up the briefing process was part of a larger attempt by Apple to hurry up the entire litigation process as rival Galaxy II smartphone continues to gain favour among consumers. 
 
Yesterday’s court verdict marks another twist in the titanic battle between the Apple iPhone and Samsung Galaxy S, which began when the Cupertino based Apple filed a patent suit against its Korean rivals, claiming Samsung copied the the “look and feel” iPhone, iPod Touch and iPad for its Galaxy smartphones and tabs on April 15. 
 
The alleged Apple clones include the Galaxy S 4G, Epic 4G, Nexus S and Galaxy Tab. “The Court agrees [with Samsung] that Apple has not established substantial harm or prejudice justifying a shortened briefing and hearing schedule for its Motion to Expedite,” the judgement read yesterday. 
 
And interestingly, the court appear to be taking Korean based Samsung’s side, to an extent, refusing to believe Apple protests that it is being damaged by the alleged patent infringements. 
 
“The Court agrees with Samsung that the length of time Apple has been aware of its claims and the long history of infringement alleged in the complaint undermine Apple’s claims of urgency to some extent.” 
 
“This does not bode well for Apple’s efforts to compress the timeline for the case as a whole and for Apple’s desire to obtain a preliminary injunction with respect to certain patents and products,” believes Florian Mueller of FOSS Patents. 

This news could come at a worse time for the iPad makers as reports have merged that its chief patent attorney Richard “Chip” Lutton Jr. is set to leave the giant in the near future. 
 
 
On July 5, the giant sought to ban US imports of Samsung’s smartphones and tabs, taking its case to the U.S. International Trade Commission, a body known for its quick decisions.
