Apple's New 4G iPad "Misleading," Alleges ACCC

At 9:30 am tomorrow morning, the ACCC will be filing an application to the Federal Court in Melbourne against Apple Inc and Apple Pty ltd for misleading customers by branding the new iPad as 4G in Australia.

Although the iPad has 4G technology, it is not compatible with the 4G frequencies used by Australian mobile networks. Despite this, the company continues to brand their sim-card enabled iPads as 4G.

“The ACCC alleges that Apple’s recent promotion of the new “iPad with WiFi + 4G” is misleading because it represents to Australian consumers that the product “iPad with WiFi + 4G” can, with a SIM card, connect to a 4G mobile data network in Australia, when this is not the case.”

The ACCC is seeking injunctions, penalties, corrective advertising and a refunds for customers who were mislead.

The ACCC warned: “Consumers who have purchased or are considering purchasing a “iPad with Wifi + 4G” should ensure that they have a proper understanding of the mobile data networks which this iPad can directly access by a SIM card.”
